AI agents are now undertaking calls end to end to make deals with the public. No human interaction. Frightening and amazing in equal measure.

You want to innovate. You want your teams to work smarter. You want technology to give people time back, to be efficient, to make more money. These are legitimate, commercially sound ambitions. But as AI became agentic, the conversation changed.

We're moving from AI that assists people to AI that can access systems and client data, communicate with clients, make and receive calls, clone voices, trigger workflows, use other applications, and take actions with limited human intervention. And the risks are evolving alongside it.

The Solicitors Regulation Authority issued its Misuse of AI warning notice on 17 August. The Nationaal Cyber Security Centrum (NCSC-NL) has now published specific guidance around managing the risks of agentic AI. We already know AI-generated voices, deepfakes and manipulated identities are being used in fraud.

For me, this comes back to one simple question: do you know exactly what your AI is authorised to do on behalf of your firm?

When you sit at the top of a regulated business, the responsibility for these decisions feels very different to simply reading about them. That's why I believe AI governance has to develop alongside AI adoption — not six months afterwards when something has already gone wrong.

AI can create enormous opportunity for law firms. I'm a huge advocate of it. But technology isn't the strategy. Know what you're trying to achieve. Understand the risk. Create a future-proof plan. Put the governance checkpoints in place. Then use the technology to succeed.
